BOOKING TERMS & CONDITIONS

The following booking conditions, together with the information set out on the relevant tour page of the Neophron Tours website, form the basis of the contract between you and Neophron Tours Ltd.

In this contract, references to “you” and “your” include the person named as the lead on the booking form/confirmation invoice (who must be at least 18 years of age at the time of booking) and any person on whose behalf a booking has been made. “We” means Neophron Tours Ltd. of 57 G. Rakovski Str., 9000 Varna, BG. Neophron Tours holds tour-operating certificate PK-01-7186, issued by the Bulgarian Government.

Making a Booking and its acceptance

You must enquire about a Tour by email. Once we receive your enquiry via email, we will send you an email with our Booking Form.

A booking is an offer by you to buy the services specified in the Booking Form (Tour) subject to these Terms. By you either submitting your Booking Form or emailing confirmation of your acceptance of the Tour, you will be deemed to have accepted the Tour, at which point we will send you a Booking Confirmation Invoice and the Contract between you and us will come into existence. The Contract will relate only to the Tour and any Tour Extension confirmed in the Booking Confirmation Invoice.

Deposits and Payments

1or tour bookings we require a deposit of 20 – 25% of the tour price per person at the time of booking, as specified in the Booking Confirmation Invoice. The balance is due 3 to 1 months prior to departure, depending on the tour logistics.  If the booking is made within 1 month of departure, full payment is due upon confirmation of the booking. All payments are made by bank transfer.

Cancellation and Refunds

Cancellations must be made in writing to Neophron Tours. Cancellations received 3 months or more prior to departure will be refunded in full; cancellations received between 90 and 31 days prior to departure will be refunded at 50% of the tour cost; cancellations received 30 days or less prior to departure (or failure to join the holiday) will NOT be refunded; all bank charges for return bank transfers will be borne by the client. Cancellation insurance is recommended.

On rare occasions, your tour may be canceled by us or by a governmental authority for reasons beyond our control / force majeure. In such circumstances all payments made to the Company will be refunded in full. The Company will not be liable for any other expenses incurred by the client in connection with the tour.

Personal Travel Insurance

You are required (as a condition of booking), to obtain personal travel insurance upon booking your tour. Most entry-level personal travel insurance products will provide you with sufficient cover for the most common travel mishaps. However, it is important to read the terms and conditions of your policy carefully to make sure that you are covered for everything you may require. Neophron Tours does not provide any personal, trip cancellation, interruption, curtailment, evacuation, and/or medical travel insurance.

Responsibility

Neophron Tours acts only as a ground operator for the passenger in all matters relating to hotel accommodation, tours and transport and as such is not responsible for any damage, expense or inconvenience caused by late arrivals or departures, changes in schedules, strikes or any other conditions, nor is it responsible for loss or damage to baggage or any of the passenger’s belongings. 

Occasionally we may have to make changes to the itinerary due to unforeseen circumstances. Most of these changes will be minor and all customers will be notified at the earliest opportunity.

The tourist services offered constitute a package within the meaning of Directive (EU) 2015/2302. You will therefore enjoy all the rights guaranteed in the EU that apply to package holidays.

The tour

Descriptions and illustrations. Any descriptions or illustrations on our website are published for the sole purpose of giving an approximate idea of the Tour described in them. They do not have any contractual force.

Itinerary. The itinerary for the Tour is available on our website. The itinerary will specify the services, which are included and excluded from the Tour price.

Changes to Itinerary. We reserve the right to amend the Itinerary if required by any applicable statutory or regulatory requirement, or if the amendment will not materially affect the nature or quality of the Tour. We will notify you in advance of any such event and any alteration in the Itinerary. This applies to all logistical changes, including that of advertised hotels or vessels. Any changes to the Itinerary will not give you the right to cancel the Contract, without us deducting the amounts under the clauseCancellation and Refunds.

What is included in the price of a Tour?

  • travel from the meeting point in the country of the tour to your return to the departure point (which is likely to be the same place);
  • accommodation, meals and drinking water (unless otherwise stated in the itinerary);
  • other services (pelagic trips, etc.) stated in the itinerary;
  • services of one or more leaders.

What is NOT included?

  • return flights to the Tour destination;
  • administration, flight booking and all other costs incurred before you board transport at the meeting place and after you return to the departure point;
  • travel insurance or any other insurance personal to you;
  • passport and visa costs;
  • vaccinations and medication, before, during and after the Tour;
  • food and drink over and above what we include in the Tour;
  • gratuities you choose to give, in addition to any we give on your behalf where we consider appropriate.

Tour leaders

We may substitute the Tour leader or leaders whose names appear on our website for other Tour leaders. Any changes to the Tour Leader or leaders will not give you the right to cancel the Tour, without us deducting the amounts under the clause Cancellation and Refunds.

Tour size

The maximum group size for a Tour is detailed on our website, we may increase the maximum group size if two people travelling together sign up for a final available place, in which case, the maximum group size may be increased by one to three persons, depending on the logistic circumstances.

Your obligations

1. It is your responsibility to ensure that:

(a) you provide us with such information and materials we may reasonably require supplying the Tour and ensure that such information is complete and accurate in all material respects.

(b) you obtain and maintain all necessary international flight tickets, visas, permissions, and consents which may be required for the Tour before the date on which the Tour is to start.

(c) you are emotionally and medically fit for the Tour.

2. If our ability to perform the Tour for you is prevented or delayed by any failure by you to fulfil any obligation listed above (Your Default):

(a) we will not be responsible for any costs or losses you sustain or incur arising directly or indirectly from our failure or delay performing the Tour; and

(b) it will be your responsibility to reimburse us on written demand for any costs or losses we sustain or incur arising directly or indirectly from Your Default.

You agree to be bound by these Terms by:

a) accepting any quotation or estimate or submitting your booking form (whether signed or unsigned);

b) utilising our services; or

c) making payment of any amount to us for any services.

Assignment and transfer

(a) We may assign or transfer our rights and obligations under the Contract to another entity but will always notify you in writing if this happens.

(b) You may only assign or transfer your rights or your obligations under the Contract to another person if we agree in writing.

Complaints

We shall try our utmost to provide a happy and fulfilling experience, but if a problem arises or you are dissatisfied with the Tour, please inform the Tour leader immediately. If the leader is unable to resolve the problem to your satisfaction, please inform us during the Tour or in writing no later than one week after the Tour has finished.

Public Liability Insurance

Neophron Tours has specific Tour Operator Liability Insurance in place, details of which may be available upon request.

Jurisdiction

In entering into a contract with us, you have relied only on the information on our website, our tour details and these terms. The contract between us is subject to Bulgarian Law and the exclusive jurisdiction of the Bulgarian courts, even if the subject matter of a dispute arises outside Bulgaria.
